Stallholder Rules and Regulations

In order to ensure that this event is a fun, safe and successful one, we have some rules and regulations that apply to stall holders.

A stallhoder "Code of Conduct" Form, is to be filled out and returned to Pleasant Street Primary School, if you are a successful stallholder.

Stallholder Code of Conduct Form

Please understand that:

  • Management reserves the right to accept or reject applications based on the applicant meeting the approved product criteria, quality, product distribution, diversity and availability.
  • All decisions made by management are final.
  • Stall positions are totally at the discretion of management.
  • Stalls cannot be transferred, sublet, shared, or sold to any other person without written approval.

Approved Products

  • All products offered for sale must be sold by the registered stallholder.
  • Products that are clearly imported or purchased from a wholesaler or are deemed inappropriate {discriminatory of offensive} by management will not be considered.
  • Stallholders must ensure they conform to safety and compliance standards pertaining to their product.
  • New products may only be added to a stall after management approval.
  • All products and stall presentation must be of the highest standard.
  • Crazy string and other like products have been banned at the Christmas fest event. Such goods are not permitted to be sold at this event

Fees and Insurance

  • Stall fees and method of payment are outlined in the application process.
  • Please note that stallholders are viewed as a business in their own right and the Department of Education and Early Childhood [DEECD] cover does not extend to protect the Stallholders for any legal liability attributable to them.
  • Stall fees do not include public liability insurance. All stallholders are responsible for their own insurance policies.
  • Fees must be paid to secure booking. Failure to do so will result in the booking being cancelled.
  • Stallholders who pay by a cheque that is dishonoured will be charged an administration fee of $15.00

Event Day

  • Registered Stallholders must be in attendance during the event trading times as advertised.
  • Stallholders must be set up and ready to trade at the commencement of the trading hours and must continue trading until the market closing time.
  • Cars or other vehicles are not permitted on the school grounds at any stage
  • Notification of non-attendance is required on market day via mobile to allow full utilization of spare space. No refunds or credits will be given on market day.
  • Raffle tickets may not be sold.

Cancellations and Refunds

  • Notification of non-attendance is required. If no notification is given then all future bookings will be cancelled and any monies paid will not be refunded.
  • A refund of monies paid will only be paid or credited if one week’s notice was given.
  • Management is not responsible for adverse weather conditions that occur on event day, therefore there are no refunds for this reason.

Adverse Weather

  • Christmas Fest will not be cancelled due to adverse weather.
  • Stallholders may pack up their stall due to adverse weather but may not move until management gives permission.
  • No refunds or credits will be given to stallholders who pack up due to adverse weather conditions.

Occupational Health and Safety

  • Stallholders will not be permitted to bring their vehicles onto the school grounds.
  • Stallholder Dogs are not permitted to enter the market.
  • Smoking on Victorian Government school premises is prohibited.
  • All stallholders in the passage ways will position their tables up against the walls, this will enable the public with prams and wheelchairs easier access to all stallholders and ensure that the event complies with occupational health and safety as well as qualifying as a disability approved venue.

Waste and Rubbish Removal

  • The waste bins provided are for the general public use only.
  • Stallholders are responsible for leaving their site and surrounding area clean, tidy and undamaged.

Stall Set-up and Equipment

  • Outside stallholders must provide their own covers and stall set-up, which must be good in presentation.
  • Stallholders must provide own tables and equipment. All stall equipment for both inside and outside stalls, including racks, tables, signage etc. must be contained to the stall site boundaries.
  • Stallholders may not alter or remove any classroom display without the express permission of Management.
  • Public access ways must be clear at all times.
  • Tents, covers and all stall equipment must be securely weighted or secured at all times.
  • All equipment must be in good repair and operated in a safe manner.

Food Stalls

As stated in General information

  • It is the responsibility of stallholders to ensure the sale of food items complies with local, State and Federal government regulations and food acts.
  • Stallholders selling food items must provide a copy of their current registration from the City of Ballarat to management BEFORE event day.
  • Stalls selling alcohol {bottle only} must supply management copies of their Liquor Licence prior to market day.
  • Failure to comply with Health Department standards and regulations may result in immediate closure of the stall.

Power and Gas Equipment

  • Power sites are limited, and power outlets may only be used with the permission of management.
  • Stallholders must ensure all electrical equipment and leads are tagged in compliance with relevant work place regulations.
  • Stallholders must ensure that all gas appliances are approved and in date.
  • Stallholders using gas and electrical equipment must have a suitable fire extinguisher or fire blanket on site.

General Stallholder Code of Conduct and Responsibilities

  • Stallholders will respond co-operatively to any direction given by management in relation to the operation and occupation of their stall, equipment, goods and vehicle during operating times.
  • Stallholders will not act in a verbally abusive, dangerous or disruptive manner. Such behaviour will not be tolerated and will result in immediate termination.
  • Stallholders are asked to respect the property of the school and not use any equipment without the consent of management.
  • Stallholders will not cause damage, make alterations of additions of any nature to site property and that, if any damage is caused, the cost of any repairs or replacement are borne by the stallholder.
  • Stallholders will report to management any incident or accident that involves loss or may give rise to claim.


The management’s consent to the stallholder to attend the event does not convey the stallholder any ongoing rights in relation to the market into the future and such approval can be terminated by the management at any time in writing and without periods of notice. The management reserves the right to undertake any of the following actions without notice.

  • Re-locate a Stallholder to another Site within the event.
  • Require the Stallholder to remove from sale any good or service offered by the stallholder which are not approved products; or
  • Request the stallholder undertake any reasonable measure which, in the opinion of the manager will improve the safety or to raise the presentation of the stall and its products.


The management reserves the right to withhold consent to a stallholder to occupy a stall at the event, to remove or to have removed from the event, a stallholder who is in breach or does not comply with the Regulations, including where a stallholder;

  • Fails to pay their stall fee in a timely manner.
  • Fails to abide by event set-up or pack-up conditions.
  • Fails to abide by the event’s trading hours.
  • Fails to abide by the event’s rules and regulations.
  • Fails to limit the products offered for sale to Approved.
  • Behaves in a manner that breaches the market’s code of conduct.
